The Bill (Reg.No.2002) seeks to amend Clause 10 of the Law, inserting additions which define the mechanism of unification through a Merger of Joinder.
The provisions of the Bill envisage that ‘two or more political parties, registered in the Ministry of Justice of Ukraine, have the right for a merger of joinder, under a reorganisation procedure as laid down in Clause 23 of this Law´.
A decision on reorganisation involving other political party/parties, must be taken by the Supreme Governing Body of the political party, in line with its Charter, but by no less than two-thirds of the votes of Deputies registered at a Congress/Forum.
The Sponsor of the Bill, People´s Deputy, Borys Tarasiuk, suggests that ‘the Ministry of Justice of Ukraine should decide on the registration of a political party set up, resulting from a merger of two or more political parties, on the basis of the Certificate of that Party which was Registered earlier, with a concurrent cancellation of Registration Certificates of other Parties´.
In a reorganisation through a merger of joinder, The Party to which the other parties are joined, shall acquire the Rights and Duties of the other parties.
B.Tarasiuk believes that the passing of this Bill will promote a better structural organisation and consolidation of political parties through their unification.
